RE: Resolving the Dispute

I would like you to know that I have been at great unease over the dispute between Por Pramuk camp & me, which arose from the Thai Fight competition held in Pattaya on 17 April 2012, This is because I have always respected you & will continue to do so. I have been trying to find a way to resolve this dispute.

On 18 April 2012, I met with Major General Intharat Yodbangtoey & proposed the following solution:

1. I request that Por Pramuk camp pays me what they owe me. The amount is 3 million baht, but I am willing to accept just half of it.

2. I am happy to waive this debt if Por Pramuk camp agrees to terminate my contract with them & cancel any other obligations that I might have with them.

3. If Por Pramuk camp agrees to pay me what they owe me (as per point 1 above), I will be happy to continue using the camp's name with the following conditions: future earnings from fights both within Thailand & overseas will be split 60:40 between me & the camp (60% for myself & 40% for Por Pramuk camp); 20% of the camp's share will be deducted each time towards paying off the sum that they owe me, until the debt is cleared; I will train on my own & take care of only my own expenses; & I will have full rights to income from public appearances, advertising & sponsorship, similar to international boxing & football stars.

Major General Intharat Yodbangtoey put forward the above proposal to you for your consideration on 29 April 2012 at the Golden Tulip Hotel, Rama 9 Road. On 01 May 2012, he informed me that you had proposed the following solution instead:

1. You are happy to let me continue using the Por Pramuk camp name.

2. The entire debt should be waived.

3. You agree to split future earnings from fights 60:40 with me (60% for myself & 40% for Por Pramuk camp) with the following conditions: that the camp has a say in decisions on fights to participate in; & that the camp's representative(s) accompany me to all fights held abroad, with me or the organiser providing at least one return air ticket.

4. Por Pramuk camp will have a share of income from public appearances, advertising & sponsorship under a mutual agreement.

I considered your proposal, & decided that in the interest of resolving this dispute, as well as to further acknowledge what the camp has done for me, to propose the following solution:

1. I am happy to waive the entire debt.

2. I wish to stop using the Por Pramuk camp name in future fights. If I am to continue using the camp's name, it will be under a new 1-year contract with the camp that can be renewed for a maximum of 1 year each time, & I alone will make all decisions on fights to participate in.

3. I will be happy to split future income from fights 60:40 with the camp (60% for myself, 40% for Por Pramuk camp) for the next 5 years, regardless of whether I continue to use the camp's name. This is to show my gratitude to the camp for their part in making me into what I am today. However, all income from public appearances, advertising & sponsorship will belong to me, in accordance with the law.

Please kindly consider my latest proposal. If Por Pramuk camp is happy to agree with this proposed solution, I ask that the lawsuit against all parties be dropped, & that my existing contract with the camp be cancelled or replaced by a new one. Please understand that I have never forgotten the kindness that you & Por Pramuk camp have shown me & I will remember it for life.

Ze waren nogal wat van plan. Por. Pramuk wilde de organisatie achter Thai Fight/Buakaw voor 5 miljoen baht aanklagen en daarnaast Buakaw laten schorsen voor een half jaarvanwege het overtreden van de boxing act.
Afgelopen 14 dagen is er nogal wat gesteggel geweest om zo de vechter meer te kunnen beschermen wat resulteerde in een aanpassing in contracten en een verkorting van de periode na een gevecht waarin niet gevochten mag worden. Dit was 21 dagen en is verkort naar 14 dagen.
Buakaw is nogal toegeeflijk en wil zelfs de 3 miljoen baht die Por. Pramuk hem schuldig is kwijtschelden, zolang het maar opgelost wordt.

Het kan alle kanten op gaan, maar alles wijst in het voordeel van Buakaw. Buakaw wordt gezien als vechter en iemand die het land eert en vertegenwoordigd op een zeer positieve manier en in dit hele gebeuren is Buakaw "slachtoffer".
Het moet wel heel raar lopen mocht Buakaw niet zeer snel op zijn manier kan vechten, maar een terugkeer naar Por. Pramuk is zo goed als uitgesloten. Hij blijft in Surin trainen in zijn eigen gym de rest staat te lezen in het verhaal. Ik vond het wel opmerkelijk dat Buakaw zelfs zijn eis van 3 miljoen baht wil laten varen om zo te kunnen vechten.

Buakaw wordt gezien als vechter en iemand die het land eert en vertegenwoordigd op een zeer positieve manier en in dit hele gebeuren is Buakaw "slachtoffer".

Vorige week was het nog bij een Thais nieuwsprogramma en ze hadden een poll onder hun kijkers; in totaal gaf rond de 94% van de mensen die de moeite nam een sms te sturen Buakaw gelijk in dit dispuut.

Buakaw heeft zijn intrede gedaan in een klooster om tijdelijk monnik te worden.
Elke Thai zal in zijn leven een periode inlassen om zichzelf te ontdekken en meer innerlijke rust te vinden.
Na de afgelopen hectische tijd is het een tijd voor rust voor Buakaw, hoe lang Buakaw in het klooster blijft is onbekend. Dit kan een paar weken zijn, een paar maanden of in het slechtste geval voor altijd.....

Een monnik vecht niet, dus ik denk dat hij zijn rust zal pakken.
Wat betreft zijn gym die zal blijven, Buakaw zal niet meer uitkomen voor Por. Pramuk tenminste hij zal er niet meer trainen. En enkel in zijn eigen gym bezig zijn, het is afwachten wat het Por. Pramuk kamp gaat besluiten tot die tijd zal Buakaw niet in actie komen.
Na de periode als monnik en hopelijk een oplossing in het geschil met Por. Pramuk zal hij nog een paar jaar ouderwets knallen.
Buakaw wacht een schorsing van een half jaar, mits het Por. Pramuk kamp hun eis niet intrekt.

hoe lang Buakaw in het klooster blijft is onbekend. Dit kan een paar weken zijn, een paar maanden of in het slechtste geval voor altijd.....

Of in het beste geval een dag, misschien twee, zoals zoveel doen (bv Anuwat Kaewsamrit).

On 10 May 2012, Por Pramuk camp's lawyer claimed that the camp had always divided earnings 50:50 between the camp & Buakaw. He alleged that problems arose because of a third party. He said that the camp is ready to negotiate with Buakaw in order to resolve the dispute, but Buakaw has been avoiding them.

The camp's lawyer also said that the camp had taken care of Buakaw's future by opening a bank account in his name for him to save for his retirement.

Mr. Teeraphat Rojanathan (Au), the head of Por Pramuk camp, said that if Buakaw does not attend the meeting with the Sports Authority of Thailand's Board of Boxing Sport on 22 May 2012, it is his right to do so. However, they will take it as an admission of guilt in breaking his contract & infringing the Boxing Act, & will pursue legal action.

It is said the power of Por Pramuk gym has extended itself as so many thought it might.
The rumor has it that Buakaw had found some very wealthy investors who were interested in bringing his name and building him a gym in South Thailand (possibly Phuket).
This move has however been suddenly and quickly put an end to. Buakaw is said to have “little to no chances” of winning his case with the SAT (Sports Authority Of Thailand) which means he will be forced to return to Por Pramuk gym…. or the worst scenario- Retire.
I really hope these rumors are un-true, however Fight Sport Asia has good connections and believes these rumors to be very true.

Buakaw's elder sister explained that everyone would like for Buakaw to be left alone in peace to study the Buddhist teachings in seclusion. They do not wish to disclose the name of the temple at which he is residing as they do not want him to be disturbed by visitors. She is concerned about her younger brother & the lawsuit that he is facing. She said that at present, his state of mind is calm & clear, & no decision has been made on when he will leave the monkhood.

Buakaw's younger sister said that on 12 May 2012, a group of 3-4 strangers & 1 monk drove up to their house in a vehicle with Phuket licence plates & tried to find out which temple Buakaw is residing at. When they could not get the answer [from her], they drove away before returning to accuse her of lying to them, making her suspicious of their intentions.

The President of the Professional Boxing Association of Thailand, Mr. Somchat Charoenwatcharawit, revealed that the ethics & disciplinary subcommittee of the Sports Authority of Thailand's Board of Boxing Sport had already decided on 16 May 2012 to suspend Buakaw for 6 months. This is because he failed to show up for negotiations with the owner of Por Pramuk camp after violating the Boxing Act by fighting in Thai Fight [on 17 April 2012]. The suspension has already been endorsed by the Minister of Tourism & Sports, ahead of the 22 May 2012 meeting [with the Board of Boxing Sport] where Buakaw is to explain his case.

Mr. Somchat said that Buakaw has the right to send a representative to explain his case or lodge an appeal [at the meeting scheduled for 22 May 2012]. However, the 6-month suspension has already been decided upon. Should Buakaw try to fight while still under the suspension, be it within Thailand or abroad, they will consider harsher penalties including confiscating his boxing licence.

The Board of Boxing Sport will soon hold a seminar for people within the muay thai community to meet & discuss amendments to the Boxing Act, with Buakaw's case used as an example.

Zouden ze hier ook eens moeten doen.. geef iedereen eens een paar weken in zijn leven en denk eens na over je toekomst. Het is lullig hoe hij behandeld is door zijn oude kamp en ik wens hem veel sterkte voor de nabije toekomst. Hij heeft nog wel een paar mooie jaren over.
