Mr Dej Jaikla revealed the ethics & disciplinary subcommittee of the Sports Authority of Thailand's Board of Boxing Sport had already decided on 16 May 2012 to suspend Buakaw for 6 months. This is because he failed to show up for negotiations with the owner of Por Pramuk camp after violating the Boxing Act by fighting in Thai Fight (on April 17,2555). The Sports Authority of Thailand (SAT) sent notices to both Buakaw and Mr. Pramuk Rojanathan for the meeting on 22 May 2555 to reveal the issues and explain Buakaw's health report from the doctors regarding his stress symptoms and ordered Buakaw to rest for his better health condition from 2-18 May 2555, Buakaw then later ordained as a Buddhist monk from 7 May - 19 May 2555, as he had reported to SAT and agreed to come to the meeting for negotiations to clarify and settle the dispute and on 22 May 2555 at 13.30pm. At this moment, Buakaw's suspension has already been endorsed by the Minister of Tourism & Sports.
The Director of National Identity of Thailand, Mr. Intarat Yodbangtoey feels strongly disagreed for the judgment of the Boxing Commission to put an order against Buakaw instead of peace negotiations between Buakaw and Mr. Pramuk Rojanathan that going to be held on 20 May 2555 . With this issue, the meeting of these two parties had been canceled. Mr. Intarat Yodbangtoey comments " Because I have nothing to negotiate anymore. Since the legislation came before the settlement by peaceful means. This may be because of impatient, or to influence the industry to fight the fear." The Sport Commission failed to follow the Boxing Act rule of 2542 - that clearly stated that they must first consider the complaint letter from Buakaw to the Boxing Commission on March 26, 2555, and Boxing Commission should be carefully considered before deciding to proceed any further decisions.
When this occurs, rather than fairness to all parties, it will cause a life-long controversy and problems that would lead to unpredictable outcome results. Mr. Intarat Yodbangtoey added to this issue that many Buddhists are now against the decision made by SAT, due to the penalty happened while Buakaw was still in his ordained and served buddhism religion, it would not be fair for Buakaw to be banned at that time. However, Buakaw would definitely come to the meeting with SAT on 22 May, 2555 for sure.
Some points to add to/emphasize in the above:
1. In the documents delivered to Buakaws home on 16 May 2012, the SAT's Board of Boxing Sport stated that in accordance with Section 21(2) of the Boxing Act (1999), they will first allow Buakaw to acknowledge the charges against him & to explain his case on 22 May 2012, before proceeding to pass judgement. (Please see translations of earlier news articles posted on 18 May 2012 for details.)
2. According to the Boxing Act (1999), before proceeding to make any decisions on Buakaw's case, the SAT & Board of Boxing Sport are first required to consider the details of the letter that Buakaw sent them on 26 March 2012 explaining why his contract with Por Pramuk camp should be terminated, & view the supporting evidence. This was stated by Major General Intharat Yodbangtoey (in the above note), who was assigned by the Deputy Prime Minister of Thailand to mediate between Buakaw & Por Pramuk camp.
3. Both the SAT & Board of Boxing Sport were fully aware that it would not be possible for Buakaw to acknowledge the charges & explain his case before 20 May 2012. They had received his medical certificate stating that he was under doctor's orders to rest until 18 May 2012 (as reported in the news on 30 April 2012), & knew that he had ordained as a monk from 6-19 May 2012.
3. The SAT & Board of Boxing Sport had thus arranged for Buakaw to meet with them on 22 May 2012 to do the above.
4. It is difficult to understand why the SAT & Board of Boxing Sport have gone ahead on 16 May 2012 to decide on the judgement & penalty. Their actions fully contradict their own words, & are highly unfair. Maj. Gen. Intharat feels that the SAT & Board of Boxing Sport themselves have now violated the Boxing Act.
5. This has wasted Maj. Gen. Intharat's efforts to resolve the problems between Buakaw & Por Pramuk camp in a peaceful way. He had arranged for both parties to meet on 20 May 2012 for negotiations, but there is no longer any point in having this meeting & he has now cancelled it.
6. This has also destroyed hopes for a quick & peaceful resolution to the dispute between Buakaw & Por Pramuk camp, which could now drag on with no predictable outcome in sight.
