Mr Dej Jaikla revealed the ethics & disciplinary subcommittee of the Sports Authority of Thailand's Board of Boxing Sport had already decided on 16 May 2012 to suspend Buakaw for 6 months. This is because he failed to show up for negotiations with the owner of Por Pramuk camp after violating the Boxing Act by fighting in Thai Fight (on April 17,2555). The Sports Authority of Thailand (SAT) sent notices to both Buakaw and Mr. Pramuk Rojanathan for the meeting on 22 May 2555 to reveal the issues and explain Buakaw's health report from the doctors regarding his stress symptoms and ordered Buakaw to rest for his better health condition from 2-18 May 2555, Buakaw then later ordained as a Buddhist monk from 7 May - 19 May 2555, as he had reported to SAT and agreed to come to the meeting for negotiations to clarify and settle the dispute and on 22 May 2555 at 13.30pm. At this moment, Buakaw's suspension has already been endorsed by the Minister of Tourism & Sports.

The Director of National Identity of Thailand, Mr. Intarat Yodbangtoey feels strongly disagreed for the judgment of the Boxing Commission to put an order against Buakaw instead of peace negotiations between Buakaw and Mr. Pramuk Rojanathan that going to be held on 20 May 2555 . With this issue, the meeting of these two parties had been canceled. Mr. Intarat Yodbangtoey comments " Because I have nothing to negotiate anymore. Since the legislation came before the settlement by peaceful means. This may be because of impatient, or to influence the industry to fight the fear." The Sport Commission failed to follow the Boxing Act rule of 2542 - that clearly stated that they must first consider the complaint letter from Buakaw to the Boxing Commission on March 26, 2555, and Boxing Commission should be carefully considered before deciding to proceed any further decisions.
When this occurs, rather than fairness to all parties, it will cause a life-long controversy and problems that would lead to unpredictable outcome results. Mr. Intarat Yodbangtoey added to this issue that many Buddhists are now against the decision made by SAT, due to the penalty happened while Buakaw was still in his ordained and served buddhism religion, it would not be fair for Buakaw to be banned at that time. However, Buakaw would definitely come to the meeting with SAT on 22 May, 2555 for sure.
Some points to add to/emphasize in the above:

    1. In the documents delivered to Buakaws home on 16 May 2012, the SAT's Board of Boxing Sport stated that in accordance with Section 21(2) of the Boxing Act (1999), they will first allow Buakaw to acknowledge the charges against him & to explain his case on 22 May 2012, before proceeding to pass judgement. (Please see translations of earlier news articles posted on 18 May 2012 for details.)

    2. According to the Boxing Act (1999), before proceeding to make any decisions on Buakaw's case, the SAT & Board of Boxing Sport are first required to consider the details of the letter that Buakaw sent them on 26 March 2012 explaining why his contract with Por Pramuk camp should be terminated, & view the supporting evidence. This was stated by Major General Intharat Yodbangtoey (in the above note), who was assigned by the Deputy Prime Minister of Thailand to mediate between Buakaw & Por Pramuk camp.

    3. Both the SAT & Board of Boxing Sport were fully aware that it would not be possible for Buakaw to acknowledge the charges & explain his case before 20 May 2012. They had received his medical certificate stating that he was under doctor's orders to rest until 18 May 2012 (as reported in the news on 30 April 2012), & knew that he had ordained as a monk from 6-19 May 2012.

    3. The SAT & Board of Boxing Sport had thus arranged for Buakaw to meet with them on 22 May 2012 to do the above.

    4. It is difficult to understand why the SAT & Board of Boxing Sport have gone ahead on 16 May 2012 to decide on the judgement & penalty. Their actions fully contradict their own words, & are highly unfair. Maj. Gen. Intharat feels that the SAT & Board of Boxing Sport themselves have now violated the Boxing Act.

    5. This has wasted Maj. Gen. Intharat's efforts to resolve the problems between Buakaw & Por Pramuk camp in a peaceful way. He had arranged for both parties to meet on 20 May 2012 for negotiations, but there is no longer any point in having this meeting & he has now cancelled it.

    6. This has also destroyed hopes for a quick & peaceful resolution to the dispute between Buakaw & Por Pramuk camp, which could now drag on with no predictable outcome in sight.

Mr. Dej Jaikla said that many people have objected to the 6-month suspension given to Buakaw for violating the Boxing Act, saying that it has upset the chances of a peaceful resolution to the dispute between Buakaw & Por Pramuk camp. He clarified that as the registrar, he has the authority to impose this suspension, & it was with the approval of the Board of Boxing Sport.

Mr. Dej said that the suspension was to punish Buakaw for fighting in Thai Fight on 17 April 2012 without permission from Por Pramuk camp. He said that Buakaw had clearly violated the Boxing Act in doing so, & that this is a separate issue from Buakaw wanting to leave Por Pramuk camp. Buakaw's request to leave Por Pramuk camp will be dealt with at the 22 May 2012 meeting between Buakaw & the Board of Boxing Sport, & as the registrar, it is Mr. Dej's duty to be impartial & seek a resolution that is fair to all parties.

When Buakaw announced on facebook that he will meet with the Board of Boxing Sport at the Sports Authority of Thailand on 22 May 2012 to resolve his problems, many of his fans responded saying that they will go down together with him to show their support.

22 May 2012. The problems between Buakaw & Por Pramuk camp have not been completely resolved. Both parties do not fully agree with the terms of a new contract between them & thus did not sign it today. Mr. Pramuk Rojanathan, the owner of Por Pramuk camp, refused to sign as he is unhappy over the request to drop his lawsuit against Buak...aw's sports science trainer, Mr. Teerawat Yioyim. In addition, Major General Intharat Yodbangtoey, the mediator in this dispute, said that he wants to give both parties more time to examine the clauses in the new contract as there are details need to be further clarified & worked out, & so they will all meet to discuss again on 31 May 2012. The reporter tried to ask Mr. Pramuk & his son Mr. Teeraphat about his objection to signing the new contract, but they refused to speak to the press & left immediately.

    1. The head of Por Pramuk camp accepts Buakaw as the camp's fighter, but allows Buakaw to train on his own elsewhere.

    2. Buakaw will represent Por Pramuk camp & no other camp.

    3. Buakaw will use the fight name 'Buakaw Por Pramuk'.

    4. This new contract will last from 22 May 2012 to 5 November 2018.
(This is to cover the remaining duration of the existing 8-year contract that Buakaw had signed with the camp back in 2010. This new contract is meant to supercede Buakaw's existing contract.)

    5. Buakaw's earnings from fights will be split 60:40 (60% to Buakaw, 40% to the camp).

    6. Buakaw's income from advertising, public appearances, & all forms of sponsorship will be split 75:25 (75% to Buakaw, 25% to the camp).

    7. Any contracts for activities mentioned in clauses 5 & 6 must be agreed upon & signed by both Buakaw & the camp in order for them to be considered valid, & a contract that offers higher benefits must be accepted over one that offers lower benefits. In addition, for advertising for (the sponsor) Boon Rawd Brewery & its group (of companies), Buakaw must be paid no less than what they had paid him in the past.

    8. All of the income will be shared according to this contract starting from the date on which it is signed, until 5 November 2018.

    9. Both parties must travel & attend all events together, be it within Thailand or overseas. Travel expenses for both parties will be covered by the party that arranged to participate in the event.

(If Buakaw accepts - with the permission of Por Pramuk camp - an invitation extended to him to fight, he must pay for Por Pramuk camp to travel together with him to the event)

    10. Por Pramuk camp will drop their lawsuit against Buakaw in return for Buakaw cancelling his request to the Sports Authority of Thailand (SAT) to terminate his existing contract with the camp, and the camp will withdraw their objection against his participation in the 17 April 2012 Thai Fight event that they filed with the SAT.

    11. Buakaw must contact Por Pramuk's lawyer regarding any contract/agreement (for activities mentioned in clauses 5 & 6) that he wants to accept.

    12. Any party who makes an agreement without the other party's permission will be fined 2 million baht. This applies to activities mentioned in clauses 5 & 6. Buakaw must agree for this clause (clause 12) to apply retroactively to cover the period from 1 March 2012 to 22 May 2012, while not with the Por. Pramuk camp.

Maj. Gen. Intharat decided to give both parties more time to examine the details of the new contract before they sign it, & so they will all meet again on 31 May 2012.

Het gaat lekker. Por.Pramuk die Buakaw aanklaagd, Buakaw die Por. Pramuk aanklaagd, Por.
Pramuk.

Sport Art Co., the organiser of Thai Fight, filed a lawsuit against Por Pramuk camp for 200 million baht in damages. Mr. Teeraphat Rojanathan (Au) was named as the defendant. Court proceedings for the lawsuit will begin on 27 August 2012.
The above lawsuit states that on 2 April 2012, Mr. Teeraphat had filed an objection with the Board of Boxing Sport of the Sports Authority of Thailand (SAT). In the objection, Mr. Teeraphat claimed that Buakaw had violated the Boxing Act by fighting in Thai Fight on 17 April 2012 without permission from Por Pramuk camp. He also claimed that the contract for fighting in Thai Fight was signed between Sport Art Co. & Buakaw himself instead of with the camp, & so it is invalid. He further claimed that it is Sport Art Co. that has to seek permission from the camp first if they want Buakaw to fight in any event.

In actual fact, Mr. Teeraphat, Buakaw & Sport Art Co. had agreed in March 2012 for Buakaw to fight on 17 April 2012 for 750,000 baht.

Furthermore, Buakaw & Sport Art Co. had signed a contract on 31 October 2010 that states that for the duration of the contract [until December 2012], Buakaw is not allowed to fight in any event unless permission is granted by Sport Art Co. Mr. Teeraphat had agreed to this contract & signed on it as a witness.

Mr. Teeraphat sent a letter from the camp requesting permission from Sport Art Co. for Buakaw to fight [in Chachoengsao] on 4 May 2012. This letter was signed on 28 February 2012 by Mr. Teeraphat. This is proof that Por Pramuk camp was aware of & acknowledged that the power to decide whether Buakaw fights lies with Sport Art Co. & not with Por Pramuk camp.

Sport Art Co. said that after Buakaw clears his dispute with Por Pramuk camp, he will definitely have to fight in Thai Fight events for the rest of 2012 as he is obliged to under his contract with them.

As for future fight events, the company would not disclose whether they will deal with Por Pramuk camp or with Buakaw directly - that will be someting to decide on only in the future. However, the company will continue to organise Thai Fight regardless of whether they are able to get Buakaw to fight next year in Thai Fight 2013.

31 May 2012. Buakaw announced his retirement from fighting after he was unable to reach an agreement with Mr. Pramuk Rojanathan of Por Pramuk camp over the new contract.

This afternoon, Buakaw met with Mr. Pramuk at the Sports Authority of Thailand (SAT) for another round of negotiations over his new contract after they failed to reach a conclusion at the previous meeting [on 22 May 2012]. Also present at today's meeting were the Deputy Governor of SAT & the President of the Professional Boxing Association of Thailand.

Before the meeting began, Mr. Dej Jaikla, the Director-General of the Board of Boxing Sport, asked the media to leave the room. However, Mr. Pramuk asked that the media be allowed to stay.

Por Pramuk camp's lawyer said that the camp was willing to drop their lawsuit against Mr. Teerawat Yioyim, Buakaw's sports science trainer, provided that Buakaw accepted the new contract. The new contract specifies that [until 5 November 2018] income from fights will be divided 60:40 (60% to Buakaw, 40% to the camp), & all other income from activities such as (but not limited to) public appearances, advertising & sponsorship will be divided 75:25 (75% to Buakaw, 25% to the camp).**

However, Buakaw's lawyer said that Buakaw should be entitled to 100% of his income from activities outside of the ring, & should not be made to share it with the camp. This is because Buakaw is already 30 years old & has at most a few years left in his career as a boxer.

When an agreement could not be reached, the camp's lawyer said that the camp would be happy to sell Buakaw off to another camp that is interested in buying him. This had been proposed by Major General Intharat Yodbangtoey (the mediator in the dispute between Buakaw & Por Pramuk camp) at the previous meeting on 22 May 2012.

Buakaw then said that since both parties could not agree, & that the outstanding issue now lies with him alone, all problems should come to an end if he retires. His family & his first muaythai teacher had never asked for money, & he has already repaid their kindness in full. Therefore, he would like to retire from boxing from now on. He will not fight again, & will not try to register [as a boxer with the Board of Boxing Sport] again under a different name. On hearing this, Mr. Pramuk & his son Mr. Teeraphat (Au) burst into applause lasting many minutes.

The Deputy Governor of the SAT said that it is most regrettable that an agreement could not be reached, & that things had to end this way. He said that it is bad for Thailand's image that Mr. Pramuk & Mr. Teeraphat had clapped happily when Buakaw said that he would retire & not continue to fight & achieve success for the nation.

Mr. Pramuk retorted that he had clapped for joy not because Buakaw will retire but because all the problems he has had with Buakaw since March will come to an end.

Mr. Pramuk later said that he regrets that Buakaw will not continue to bring fame to Thailand, & claimed that the dispute had to end this way because of a 'third party'. He thinks that this would not have happened if not for issues related to money, & that in the past, the careers of famous boxers have ended because of such problems. In any case, he is relieved that things have come to an end.

Buakaw said that it is regrettable that he has to retire even though he is still able to fight. However, he wanted to end this dispute once & for all. He had thought about it [the decision to retire] beforehand, & confirmed once again that there was no 'third party' behind his decision.

Buakaw also said that he has brought fame to the country all along, & it is better for him to retire when he is at the top, rather than to retire when his career is fading away.

When everything has been settled, Buakaw will not leave the muaythai scene totally, but return to his home in Surin province to train a new generation in muaythai at his Banchamek Gym. Many children have applied to join his gym, including the children of foreigners. When asked if he would consider becoming a promoter, he said that it is too early to think about it now.

Buakaw would like to apologise to all of his fans for his decision to retire, & assures everyone that this is not the last that they have seen of him. He would like to thank everyone & the whole country for their support & encouragement. In addition, he would like young fighters to view his case as an example, & hopes that this will be the last time such a case ever happens in the muaythai scene.
